Abukai, Inc. (“Abukai” or the “Company”) is committed to protecting the privacy of your information. This Privacy Statement describes Abukai’s information practices.

1. Web Sites and Mobile Applications Covered
This Privacy Statement covers the information practices of Web sites that link to this Privacy Statement: http://abukai.com; https://abukai.com (collectively referred to as “Abukai’s Web sites” or “the Company’s Web sites”) and the iOS, Blackberry and Android applications from Abukai, which may be downloaded on Apple’s App Store, Google Play, Amazon’s App Store and potentially other app stores. The Privacy Statement also covers any emails sent to Abukai email addresses, aliases, information sent via web form or voice mails left for Abukai employees, service providers, contractors or agents.

Abukai’s Web sites and Mobile Applications may contain links to other Web sites. Abukai is not responsible for the information practices or the content of such other Web sites. The Company encourages you to review the privacy statements of other Web sites to understand their information practices. 

Abukai offers a variety of services that are collectively referred to as the “Service.” Abukai’s Web sites and Service are targeted at businesses and not individuals. Abukai collects information from individuals who visit the Company’s Web sites (“Visitors”) and individuals who register to use the Service as part of their company’s Abukai account via the Web sites or Mobile Applications (“Customers”). 

2. Personal Information You Provide or is Collected in Order to Provide Service/with a Service Agreement

Once a person has signed a Services Agreement with Abukai, Abukai uses a legal contract as the basis for processing all personal information associated with that person and/or the related company.

 

Information You Submit to Abukai

When registering to use the Service, you may have provided your email address and other contact details to Abukai through our support, service or sales functions. You agree that ABUKAI as a legal right to process any information you send to Abukai.

 

You may have provided Abukai with contact information, such as name, company name, and email address (“Required Contact Information”). When purchasing the Service, Abukai requires you to provide the Company with financial qualification and billing information, such as billing name and address, bank information, and the number of employees within the organization that will be using the Service (“Billing Information”). Abukai may also ask you to provide additional information, such as company number of employees, or industry (“Optional Information”).

 

Web Site Navigational Information
As you navigate the Company’s Web sites, Abukai may also collect information through the use of commonly-used information-gathering tools, such as navigational cookies and Web beacons (“Web Site Navigational Information”). Web Site Navigational Information includes standard information from your Web browser (such as browser type and browser language), your Internet Protocol (“IP”) address, and the actions you take on the Company’s Web sites (such as the Web pages viewed and the links clicked).

 

Abukai uses commonly used information-gathering tools, such as cookies, to collect information as you navigate the Company’s Web sites (“Web Site Navigational Information”). This section describes the types of Web Site Navigational Information the Company may collect and how the Company may use this information. 

Navigational Cookies
Abukai uses cookies to make interactions with the Company’s Web sites easy and meaningful. When you visit one of the Company’s Web sites, Abukai’s servers send a cookie to your computer. Standing alone, cookies do not personally identify you. They merely recognize your Web browser. Unless you choose to identify yourself to Abukai, either by responding to a promotional offer, opening an account, or filling out a Web form (such as a “Contact Us”, “Submit CV” or a “Custom Account Request” Web form), you remain anonymous to the Company. 

Cookies

If you have chosen to identify yourself to Abukai, the Company uses session cookies containing information to allow the Company to uniquely identify you. Each time you log into the Service, a session cookie containing an unique identifier that is tied to your account is placed in your browser. These session cookies allow the Company to uniquely identify you when you are logged into the Service and to process your online transactions and requests. Session cookies are required to use the Service. Abukai uses persistent cookies that only the Company can read and use to identify browsers that have previously visited the Company’s Web sites. When you purchase the Service or provide the Company with personal information, a unique identifier is assigned you. This unique identifier is associated with a persistent cookie that the Company places on your Web browser. The Company is especially careful about the security and confidentiality of the information stored in persistent cookies. If you disable your Web browser’s ability to accept cookies, you will be able to navigate the Company’s Web sites, but you will not be able to successfully use the Service. Abukai may use information from session and persistent cookies in combination with Data About Abukai Customers to provide you with information about the Company and the Service. Please refer to the larger Cookies section below for descriptions of Session Cookies. Additional Cookies not listed below may be used to deliver Service.


IP Addresses
When you visit Abukai’s Web sites, the Company collects your Internet Protocol (“IP”) addresses to track and aggregate non-personally identifiable information. For example, Abukai can use IP addresses to monitor the regions from which Customers and Visitors navigate the Company’s Web sites. Abukai also collects IP addresses from Customers whey they log into the Service as part of the Company’s “Identity Confirmation” and “IP Range Restrictions” security features. Abukai also tracks IP address for other security purposes such as identifying errors, or possible attack or competitor attack attempts on Abukai’s property.

Third Party Cookies
From time-to-time, Abukai also engages third parties to track and analyze non-personally identifiable usage and volume statistical information from individuals who visit the Company’s Web sites. Abukai may also use other third-party cookies to track the performance of Company advertisements. The information provided to third parties does not include personal information, but this information may be re-associated with personal information after the Company receives it. This Privacy Statement does not cover the use of third party cookies. 

 

Mobile Application

As you use our Mobile Applications, ABUKAI may also collect the following information as you submit data through the mobile application: receipt images (and data contained within), any information you enter such as notes, labels or of any other type into the application, phone location(s), email address(es) you provide us, phone model, phone operating system, and phone IMEI. When you download and use the Abukai Mobile Applications, we automatically collect information about the type of device you use and operating system version. We use mobile analytics software to allow us to better understand the functionality of our Mobile Application on your phone. This software may record information such as how often you use the Mobile Application, the events that occur within the Mobile Application, aggregated usage, performance data, and where the Mobile Application was downloaded from to perform our Services, and also route and target communications to the right staff.

 

Support and Service Inquiries

You may send us support or service inquiries via phone, email or web form. All information contained is such communication including files, screen shots, receipts, contact information and the content of such emails will be processed in order to fulfill your service request. You agree that ABUKAI as a legal right to process any information you send to Abukai in relation to support issues.

 

Corporate Customers

In some cases we collect information provided by our Corporate customers, and in such cases, we have no direct relationship with the individuals whose Personal Data we process. If you believe are using Abukai as a part of a Corporate customer account, please contact your Corporate account administrator to understand what data they share with Abukai.

 

Customer Testimonials
Abukai posts a list of Customers and testimonials on the Company’s Web sites that contain information such as Customer names and titles. ABUKAI will only post this information if customer grants that right in a Services Agreement or grants that right via written permission.

 

Third Party Services Authorized by Customers

Customers may authorize third parties to send Abukai certain information such as accounting details, organizational information, project codes or other information. Some of these connections are automated, such as in the case of accounting software. In these circumstances, Customer’s action to provide access and request the connection of the software serves as a legal basis for Abukai to receive and process the Customer information in order to fulfill the Services Agreement. Abukai will only send this data to these Third Parties with the authorization of the customer and for the purposes requested by the Customer or to fulfill any other contracts in place such as Abukai Services Agreements.

 

Forward Reports
Customers may choose to use the Forward Reports function in our Mobile Application, you must seek that person’s consent to our use of their name and email address to contact them about the Abukai Service. By providing us with their name and email address, you warrant that your designated email forward recipient consents to such contact. By providing us with an email address to forward your reports, you agree that we may share your personal information with that person.

 

Referrals

Customers may choose to refer Abukai to a colleague or other person that might be interested in Abukai services. You must seek that person’s consent to our use of their name and email address so that we may contact them about the Abukai Service. By providing us with the name and email address of a referral, you warrant that your referral consents to such contact.

 

Why We Collect this Information

Abukai will use this information to effectively deliver the Service to you and other customers, answer any requests carry out any other instructions you might provide.

 

Uploading, forwarding or emailing any document, email, attachment or other information to Abukai means your explicitly agree that Abukai is to process such data and retain such information as Abukai is legally required to retain any such information in the case of potential legal action, render any contractual services to you and others, and to improve its quality of services, and for learnings and training purposes for Abukai to rightfully operate its business. You herewith acknowledge that any such sharing of information with Abukai represents an explicit written authorization for Abukai to process such information. You herewith instruct Abukai, as documented here, to process any such information you provide or have provided to Abukai indefinitely. You also acknowledge and agree herewith that Abukai has the legal requirement to retain such information.

 

Required Contact Information, Billing Information, and Optional Information are referred to collectively as “Data About Abukai Customers.” In registering to use the Service, you will be creating an account with the Company (“User Account”), which contains the Required Contact Information and may contain Billing Information or Optional Information. You or your Company are the sole custodian of your User Account and you are responsible for the accuracy of all information contained in your User Account or otherwise provided to Abukai as personally identifiable information. You agree that Abukai is only a facilitator of the Service and has no responsibility for the accuracy of any such information. 

 

Abukai also passes Billing Information to a third party payment processor solely to check the financial qualifications of prospective Customers and to collect payment for the Service. 


Do Not Track
California Law requires us to let you know how we respond to web browser Do Not Track (DNT) signals. Abukai does not respond to DNT signals. However, some third party sites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. When you use such sites, you can change your web browser’s settings to reflect your cookie preferences. Each browser is a little different, but usually these settings are under the "options" or "preferences" menu.

 

3. Use of Information Collected- Service Agreement Customers

All data that you provide to Abukai in the form of emails, web forms, phone calls, voice mails or forms on third party websites will be used to fulfill your request or inquiry. You are not required to provide any of this information, so by providing it, you expressly agree that Abukai has a legitimate interest in processing that information and contacting you.


The Company uses Data About Abukai Customers to perform the Service requested. For example, if you fill out a “Contact Us” Web form, the Company will use the information provided to contact you about your interest in the Service, answer questions, learn and train staff. Furthermore, you herewith grant full rights and ownership in any ideas, concepts, enhancement or other information you have provided to Abukai or its affiliates.

 

The Company may also use Data About Abukai Customers for marketing purposes. For example, the Company may use information you provide to contact you to further discuss your interest in Abukai or the Service, and to send you information regarding the Company and its partners, such as information about promotions or events. Customers may opt out of communications not required for the fulfillment of any Service agreement or fulfilling any inquiries initiated by the Customer’s inquiries or use of Abukai Services. Customers wishing to opt out of these communications should contact Abukai at https://secure.abukai.com/secure/?id=contact.



Abukai uses Web Site Navigational Information to operate and improve the Company’s Web sites. The Company may also use Web Site Navigational Information in combination with Data About Abukai Customers to provide personalized information about the Company. 

Abukai may use your personal information, including your email address and any other contact information you provide us, for account maintenance and delivery of our Services, including: the creation of your account on our network, to identify you as a user in our system, to improve the quality of experience when you interact with the Abukai Service, including staff training, to send you a welcome email to verify ownership of the email address provided when your account was created, to send you administrative email notifications, such as security or support and maintenance advisories, to collect fees and payments owing to us; to respond to your inquiries related to employment opportunities or other requests and to resolve disputes; to send with your consent (or where a friend has referred you to us) promotional communications; to provide you with electronic newsletters, or surveys; to send with your consent (or where a friend has referred you to us) upgrades and special offers related to the Abukai Service and for other marketing purposes of Abukai or our Partner Companies; to make telephone calls to you, from time to time, as a part of secondary fraud protection or to solicit your feedback; and to compare information provided by you for accuracy and verification with third parties. Customers are responsible for maintaining the security and confidentiality of their Abukai usernames and passwords. Customers are responsible for any personal data of users that they provide to ABUKAI.

 

Abukai uses phone location and receipt and invoice image data in order to deliver contractual Services to customers. Abukai may also use anonymized receipt images and data in order to deliver and improve Services as part of the contractual arrangement with Abukai.

 

From time to time, we may also use your Personal Data to send important notices to you, such as communications about purchases you have made, or changes to our terms and conditions or other policies. This information is important to your interactions with us and you acknowledge that you may not opt out of receiving these communications. Abukai does not use data for purposes other than those for which it was supplied.  If this changes in the future, Abukai will update our policy and provide EEA individuals with a choice on how your data is used.

 

 

In some cases we collect information provided by our Corporate customers, and in such cases, we may have no direct relationship with the individuals whose Personal Data we process. If you believe your Personal Data has been collected by us in such circumstances, and would no longer like to be contacted as an employee or customer of one of our Corporate customers, please contact that Corporate customer directly in order to request your removal.

 

Resumes and job application information submitted directly to Abukai, via email, to Abukai personnel or via a job application form on a third party website may be used assess an applicant’s qualifications and fit for a role at Abukai. Abukai may keep that data on file to consider the applicant at a later date.

 

Abukai uses other information submitted on web forms, via email or phone to answer specific inquiries, such as those from potential business partners, investors, press or analysts.

 

 

4. Personal Information You Provide to Abukai or Is Collected by Abukai (without Service Agreement)

Sales and Partnering inquiries

When expressing an interest in obtaining additional information about the Service, you may have provided your email address, phone number, company name, and other contact details to Abukai through our sales functions including web forms, email or voice mail. You agree that Abukai as a legal right to process any information you send to Abukai. If you do not want Abukai to follow-up with you, do not provide the information you wish to not share.

 

Press/Analyst Inquiries

Publications may reach out to Abukai in order to gather information. As a member of the press or analyst community, you may have provided your email address, phone number, company name, and other contact details to Abukai through our press or analyst web form or email addresses or voice mail. You agree that Abukai as a legal right to process any information you send to Abukai.

 

Job Applications Including Applications from the EU, the United Kingdom, and/or Switzerland

Resumes and job application information submitted directly to Abukai, via email, to Abukai personnel or via a job application form on a third party website may be used assess an applicant’s qualifications and fit for a role at Abukai. Abukai may keep that data on file to consider the applicant at a later date. Abukai may also choose to invite you to an interview or request additional information to evaluate an applicant.

App Reviews

You may have submitted public reviews on a third party marketplace about the Abukai Services. Abukai may have the right to use that information as well. Please check the privacy settings of each place you post a review.

 

Other Inquiries

You may have provided your email address, phone number, company name, and other contact details to Abukai through our web form or email addresses or voice mail. You agree that Abukai as a legal right to process any information you send to Abukai.

 

Basis for Processing Any Information Submitted to Abukai via Email, Web Form, Phone or Voicemail

You herewith agree and acknowledge that Abukai and its affiliates has a legitimate business need, legal right, and requirement for legal reasons to retain any information or data you or a 3rd party on your behalf submitted to Abukai. If you do not agree, you have the right and option to not forward any such information to Abukai to retain and process. You acknowledge that your option to not provide your personal data to Abukai or a 3rd party, who then sends the data on to Abukai, satisfies the your rights to controlling your personal information. By supplying Abukai with any information, you agree that Abukai has a legitimate interest to retain and process that information for its ongoing business purposes.  

 

Herewith, you legally agree and acknowledge that any rights to audit Abukai or any of its affiliate are herewith satisfied through any audits that Abukai may conduct due to the normal nature of Abukai's business and that Abukai chooses to conduct. You legally agree and acknowledge that you are fully satisfied with Abukai's choice of any auditors and with delegating any choice of auditor herewith to Abukai if you may have any rights or cause to audit Abukai.

 

Further you acknowledge that you herewith agree that Abukai, taking into account the nature of the processing, has in place the appropriate technical and organizational measures in place to process such data. You also acknowledge herewith that we have provided sufficient notices to you of potential future processors and that you had sufficient opportunity to object prior to entering into this Agreement.

Abukai may use information from Web beacons in combination with Data About Abukai Customers to provide you with information about the Company and the Service.

6. Sharing of Information Collected
Abukai may share Data About Abukai Customers with the Company’s agents, affiliates, business partners, consultants and representatives so that these parties can contact Customers and Visitors who have provided contact information on our behalf. Abukai may also share Data About Abukai Customers with the Company’s agents, affiliates, business partners, consultants and representatives to ensure the quality of information provided. Abukai sends data to these third parties only in order to deliver the Abukai Services, including provide support, engaging in sales inquiries, or to fulfill any other contracts in place such as Abukai Services Agreements. Abukai does not share, sell, rent, or trade personally identifiable information with third parties for their promotional purposes. 


Abukai may transfer Personal Data to 3rd parties or contractors that help us provide the Abukai Service. Transfers to subsequent third parties are covered by the provisions in this Policy regarding notice and choice and the Service Agreements with our users.


Abukai reserves the right to disclose personally identifiable information of the Company’s Customers or Visitors if required by law or if the Company reasonably believes that disclosure is necessary to protect the Company’s rights and/or to comply with a judicial proceeding, court order, or legal process.

7. Adjusting Privacy Preferences for Website and Mobile Data Collection of Persons Residing in the European Economic Area (EEA) pursuant to GDPR

Adjusting consent for the Abukai Web Sites

In case of withdrawal of consent, Abukai will not process Personal Data subject to this consent any longer unless legally required to do so (for example to track past purchases and transactions). In case Abukai is required to retain your Personal Data for legal reasons your Personal Data will be restricted from further processing and only retained for the term required by law. However, any withdrawal has no effect on past processing of personal data by Abukai up to the point in time of your withdrawal. Furthermore, if your use of an Abukai offering requires your prior consent, Abukai will not be (any longer) able to provide the relevant service, offer or event to you after your revocation. Please note that an ABUKAI Services Agreement also provides the legal basis to process such information.

 

Adjusting Preferences for the Abukai Mobile Applications

Abukai mobile applications may collect the following information via the mobile application: your phone’s location, your language preferences, your carrier information. Most information collected is required for the Service to function. For Personal Data collected in the Abukai mobile application, to adjust location or camera consent for the Abukai mobile application, please use the operating system permissions selector on your mobile device. Required Shared Preferences enable the Service, provide receipt recognition and storage and allow for email report delivery. Additional Shared Preferences enable Abukai to obtain additional general information about how users are using the application and Service to improve the application. To adjust between Required and Additional Shared Preferences, please delete the mobile application and associated data from your device and reinstall the application from the mobile application store.


8. Requesting, Correcting, Updating, and Deleting Your Information (only available for Certain Visitors and Customers)

If you are based within the EEA, or within another jurisdiction having similar data protection laws, in certain circumstances you have the following rights:

  • the right to be told how we use your information and obtain access to your information;
  • the right to have your information rectified or erased or place restrictions on processing your information;
  • the right to object to the processing of your information e.g. for direct marketing purposes;
  • the right to have any information you provided to us on an automated basis returned to you in a structured, commonly used and machine-readable format, or sent directly to another company, where technically feasible (“data portability”);
  • where the processing of your information is based on your consent, the right to withdraw that consent subject to legal or contractual restrictions;
  • the right to object to any decisions based on the automated processing of your personal data, including profiling; and

Please note that only customers with these rights will have access to these procedures. If we hold any information about you, which is incorrect or if there are any changes to your details, you may see the information stored and rectify such information, at your discretion here. You are responsible for any incorrect information that you provide Abukai. You are personally responsible to rectify such information with the provided tool in the User Portal or through your Corporate Account. If you withdraw your consent to the use of your personal information for purposes set out in our Privacy Notice, we may not be able to provide you with access to all or parts of our Web site, applications, and services.

 

We will retain your personal information for the duration of our business relationship and afterwards for as long as is necessary and relevant for our legitimate business purposes, in accordance with the ABUKAI Data Retention, Marking and Destruction Policy or as otherwise permitted applicable laws and regulation. Where we no longer need your personal information, we will dispose of it in a secure manner (without further notice to you).

 

You can request from Abukai at any time information about which Personal Data Abukai processes about you and the correction or erasure of such Personal Data. Please note, however, that Abukai can delete your Personal Data only if there is no statutory obligation or prevailing right of Abukai to retain it. Kindly note that if you request that Abukai erase your Personal Data, you will not be able to continue to use any Abukai service that requires Abukai’s use of your Personal Data. If Abukai uses your Personal Data based on your consent or to perform a contract with you, you may further request from Abukai access to a copy of the Personal Data or a transfer of that data that you have provided to Abukai by filling out this form. Abukai will carefully consider your request and discuss with you how it can best fulfill it. For ABUKAI Expenses, you may obtain a copy of your Personal Data by logging on to the user portal at abukai.com/user. You may also rectify any incorrect Personal Data there.

 

Furthermore, you can request from Abukai that Abukai restricts your Personal Data from any further processing in any of the following events: (i) you state that the Personal Data Abukai has about you is incorrect, (but only for as long as Abukai requires to check the accuracy of the relevant Personal Data), (ii) there is no legal basis for Abukai processing your Personal Data and you demand that Abukai restricts your Personal Data from further processing, (iii) Abukai no longer requires your Personal Data but you claim that you require Abukai to retain such data in order to claim or exercise legal rights or to defend against third party claims or (iv) in case you object to the processing of your Personal Data by Abukai (based on Abukai’s legitimate interest as further set out in B. below) for as long as it is required to review as to whether Abukai has a prevailing interest or legal obligation in processing your Personal Data.

 


9. Abukai’s Notice of Certification Under the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework For EU and Swiss Data Transferred to the U.S.

Effective as of November 12, 2018. Abukai has certified certain of our services, for which we act as a data processor, under the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework (the certification can be found here). The following section only applies to residents of the EEA, the United Kingdom, and Switzerland whose data has been transferred into the United States.

 

Scope

Abukai adheres to the principles of the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework with respect to personal data submitted by Abukai’s customers in reliance on the Privacy Shield to the following online services: ABUKAI Expenses, ABUKAI Invoices, ABUKAI Presentations, ABUKAI ToDo, and other ABUKAI services that may be made available.

 

Data Processed

Abukai provides online services that our customers use to operate aspects of their businesses. These include services for processing expense reports and invoices, project management and sales. In providing these tools, Abukai processes data our customers submit to our services or instruct us to process on their behalves. While Abukai’s customers decide what data to submit, it typically includes information about their expenditures, accounting systems, customers, employees, and more.

 

Purposes of Data Processing

Abukai processes data submitted by customers for the purpose of providing Abukai’s online services to our customers. To fulfill these purposes, Abukai may access the data to provide the services, to correct and address technical or service problems, or to follow instructions of the Abukai customer who submitted the data, or in response to contractual requirements.

 

 

Third Parties who May Receive Personal Data

Abukai uses a limited number of third-party service providers to assist us in providing our services to customers. These third party providers offer customer support to our customers, perform database monitoring and other technical operations, assist with the transmission of data, and provide data storage services. These third parties may access, process, or store personal data in the course of providing their services. Abukai maintains contracts with these third parties restricting their access, use and disclosure of personal data in compliance with our Privacy Shield obligations, and Abukai may be liable if they fail to meet those obligations and we are responsible for the event giving rise to damage.  Note that Abukai does not share data with Privacy Shield non-agent third parties (as defined by the Privacy Shield principles) except for those expressly authorized by Customers. If that practice should change in the future we will update this policy and provide individuals with opt-out or opt-in choice as required.

 

 

U.S. Federal Trade Commission Enforcement

Abukai’s commitments under the Privacy Shield are subject to the investigatory and enforcement powers of the United States Federal Trade Commission.

 

Abukai acknowledges the right of EU, United Kingdom, and Swiss individuals to access their personal data pursuant to the Privacy Shield.  Individuals wishing to exercise this right may do so by filling out this form.

 

Compelled Disclosure

Abukai may be required to disclose personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

 

Abukai complies with the EU-US Privacy Shield Framework and the Swiss-US Privacy Shield Framework as set forth by the US Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries, the United Kingdom, and Switzerland transferred to the United States pursuant to Privacy Shield.  Abukai has certified that it adheres to the Privacy Shield Principles with respect to such data. If there is any conflict between the policies in this privacy policy and data subject rights under the Privacy Shield Principles, the Privacy Shield Principles shall govern. In compliance with the Privacy Shield Principles, Abukai commits to resolve complaints about your privacy and our collection or use of your personal information transferred to the United States pursuant to Privacy Shield. European Union individuals with Privacy Shield inquiries or complaints should first contact Abukai here.

 

Abukai has further committed to refer unresolved privacy complaints under the Privacy Shield Principles to an independent dispute resolution mechanism, the BBB EU PRIVACY SHIELD, operated by the Council of Better Business Bureaus. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit www.bbb.org/EU-privacy-shield/for-eu-consumers for more information and to file a complaint. This service is provided free of charge to you.

10. Security
Abukai uses robust security measures to protect Customer Data from unauthorized access, maintain data accuracy, and help ensure the appropriate use of Customer Data. When the Service is accessed using Internet Explorer version 6.0 or later, Firefox version 2.0 or later, or Safari version 3.0 or later, Secure Socket Layer (“SSL”) technology protects Customer Data using both server authentication and data encryption. These technologies help ensure that Customer Data is safe, secure, and only available to the Customer to whom the information belongs and those to whom the Customer has granted access. Abukai also hosts its Web sites in a secure server environment that uses firewalls and other advanced technology to prevent interference or access from outside intruders. Abukai also offers enhanced security features within in some of its Services that protect Customers from non-employees linking to a corporate account.
Because the Company uses the Service to maintain Data About Abukai Customers, this information is secured in the same manner as described above for Customer Data. Your User Account is also protected with certain user credentials, such as a valid user name and password. You are responsible for taking all reasonable steps to ensure that no unauthorized person shall have access to your User Account, user name, or password. It is your sole responsibility to authorize, monitor, and control access to and use of your user name, password, and User Account by third parties. Despite our efforts to use these security measures to protect Customer Data, we do not warrant or represent that your User Account will be protected against, loss, misuse, or alteration by third parties. 

 

11. Restrictions
Use of this Web Site by Children

This Web site is not intended for anyone under the age of 18 years. If you are younger than 18, you may not register with or use this Web site. If you are a parent or guardian and believe we may have collected information about a child, please contact us here.

 

Russia-Specific Provisions

The following applies to users who are resident in the Russian Federation: The services hereunder are not intended for use by citizens of the Russian Federation who are resident in Russia. If you are a Russian citizen residing in Russia, you are hereby notified that any Personal Data that you input into the services will be solely at your own risk and responsibility, that you expressly agree that Abukai may gather your Personal Data and will process this data in the United States and in other countries, and that you will not hold Abukai accountable for any potential non-observance of legislation of the Russian Federation.

 

12. Changes to this Privacy Statement
Abukai reserves the right to change this Privacy Statement. Abukai will provide notification of the material changes to this Privacy Statement through the Company’s Web sites. Your continued use of the Abukai’s Web sites following the posting of changes to the Privacy Statements means that you accept the changes and agree with all of the terms contained therein.
